Project Expedition Terms of Use

1. Overview
1.1. Welcome to ProjectExpedition.com (together with all related domains, white label and affiliate Websites, the “Website”). The Website is a platform where users can discover and book day-tours, multiday trips, shore excursions, transfers, and other travel experiences and services (individually, a “Product”, or collectively, the “Products”). The terms “we”, “us”, “our”, and “Project Expedition” refer to Project Expedition LLC. The terms “you”, “your”, and “yourself” refer to you, the user of the Website or Products. By accessing the Website, or participating in any Products booked via the Website, you accept and agree to be bound by these Project Expedition Terms of Use (the “Terms of Use”) and our Privacy Policy.
1.2. Project Expedition does not directly operate any of the Products listed on the Website. All Products listed on the Website are operated by independent, third party companies (the “Suppliers”). Project Expedition facilitates the purchase or reservation of these Products (“Bookings”) on behalf of the Suppliers.
1.3. Project Expedition makes no warranty of any kind, either expressed or implied, in relation to the accuracy or correctness of any information that appears on the Website, including prices, descriptions, availability, photos, reviews, coordinates, or any other information available on the Website. Project Expedition reserves the right to modify, add, or remove any information on the Website at any time, for any reason.
1.4. Project Expedition may, from time to time, update and amend these Terms of Use without notification. Please review these Terms of Use regularly, as your continued participation and use of the Website confirms that you agree to be legally bound by these Terms of Use.
1.5. If you wish to contact Project Expedition, you will find our contact information listed at the bottom of each page on the Website.

2. User Accounts
2.1. Users of the Website have the option to register an account as a traveler, travel advisor (“Travel Advisor Account”), or supplier (“Supplier Account”), (collectively, a “User Account”). If you choose to register a User Account, your personal information associated with your User Account is subject to our Privacy Policy. If you do not agree with these Terms of Use, or the terms set forth in the Privacy Policy, please do not register a User Account or use the Website.
2.2. Travel Advisor Accounts are subject to these Terms of Use in addition to the Travel Advisor Terms and Conditions. The Travel Advisor Terms and Conditions can be accessed at any time by clicking the button labeled “Terms” within your User Account dashboard.
2.3. 2.3. Supplier Accounts are subject to these Terms of Use in addition to the Supplier Terms and Conditions. The Supplier Terms and Conditions can be accessed at any time by clicking the button labeled “Terms & Conditions” within your User Account dashboard.
2.4. You are responsible for safeguarding the password to your User Account.
2.5. You are responsible for all activity and Bookings that take place via your User Account.
2.6. You are not permitted to create a User Account on the Website if you are a competitor of Project Expedition, if you are representing someone other than yourself, or if you are engaging in illegal or malicious activity.
2.7. Project Expedition reserves the right to terminate User Accounts at any time, for any reason.

3. Contributed Content
3.1. All content and information that you upload, submit, or otherwise contribute to the Website, including any descriptions, photos, videos, reviews, posts, uploads, comments, and ratings (“User Content”) may be altered, modified, or removed at Project Expedition’s discretion.
3.2. By uploading or submitting User Content, you agree to allow Project Expedition to use or distribute your User Content across any medium, for any reason, and without attribution.
3.3. You understand and agree that you will not be compensated for your User Content, regardless of how it is used by Project Expedition.
3.4. If your User Account is terminated for any reason, Project Expedition may continue to use your User Content.
3.5. You confirm that you have the legal right to use and distribute any User Content that you upload or submit to Project Expedition. In the event that you upload or submit anything that infringes on an existing copyright or trademark, you agree to assume all legal and financial liability that may arise from an intellectual property dispute or lawsuit.

4. Payments
4.1. Payments can be made with major credit cards and debit cards. Payments are processed by a third-party payment processor contracted by Project Expedition (“Payment Processor”).
4.2. Full payment is due at the time of booking unless agreed otherwise, or unless you are booking a Product that requires a deposit at the time of booking (“Deposit Products”).
4.3. Deposit Products require that you pay a deposit at the time of booking for a Booking to be confirmed. You are responsible for paying the remaining balance on the Booking directly to the Supplier, on the day of your reservation. Failure to do so may result in the cancellation of your booking, and the forfeiture of your deposit.

5. Pricing
5.1. All prices include local taxes and payment processing fees, unless stated otherwise.
5.2. Prices do not include gratuities, insurance, visas and immigration fees, or any item not listed in the inclusions section of the Product page, unless stated otherwise.
5.3. Prices are subject to change without notice until a Booking is confirmed.
5.4. You have the option to view prices and make Bookings in the following currencies (individually, a “Payment Currency” or collectively, the “Payment Currencies”): United States Dollar (“USD”), Euro (“EUR”), British Pound (“GBP”), Australian Dollar (“AUD”), and Canadian Dollar (“CAD”).
5.5. The default Payment Currency on Project Expedition will be USD until you manually change it. You can change your default Payment Currency in your User Account or in the footer of any page on the Website.
5.6. If a Supplier lists a price for a Product (the “Supplier Price”) in a different currency to your default Payment Currency, Project Expedition will automatically convert the Supplier Price to your default Payment Currency (a “Converted Price”) at an exchange rate determined by Project Expedition. Please note that Converted Prices will fluctuate over time, as the exchange rate of the underlying Supplier Price changes.

6. Price Matching
6.1. If you find a tour or activity on Project Expedition that is being sold at a lower Retail Price by the same Supplier, for the same tour, in the same currency, and for the same date and time, then Project Expedition will match that price once verified by Project Expedition (“Price Matching”). The Retail Price does not include any discounts, sales, promotions, or deals. Price Matching is not available for transfers or custom quotes.
6.2. Bookings that qualify for Price Matching will be refunded the difference between the price paid, and the price matched.
6.3. All final Price Matching decisions will be made at the sole discretion of Project Expedition.

7. Booking Vouchers
7.1. When you make a Booking, you will receive an email containing a formatted view of all critical and relevant information pertaining to your reservation (“Booking Voucher”). You will also have the option to download a Booking Voucher as a PDF. If you have a User Account, you can view your Booking Vouchers within your User Account at any time.
7.2. If you book a Product with instant confirmation, your Booking Voucher will indicate that your Booking is “Confirmed” immediately after making the booking.
7.3. If you book a Product that does not offer instant confirmation, your Booking must be manually confirmed by the Supplier. After purchase, your Booking Voucher will initially indicate that your Booking is “Pending Confirmation.” Once confirmed, you will receive another email with an updated Booking Voucher. Please allow up to 48 hours for a Supplier to manually confirm a Booking.
7.4. You must have your Booking Voucher available on the date of service so that you have the contact information of the Supplier should any unexpected circumstances arise.

8. Cancellations, Modifications, and Complaints by the User
8.1. You are responsible for checking the cancellation policy that applies to each Product prior to making a Booking. You will find the cancellation policy listed at the bottom of each Product page on the Website and on the Booking Voucher of confirmed Bookings.
8.2. If you need to cancel or modify a Booking, you must submit your request online via the "Manage Bookings" page. The "Manage Bookings" page can be accessed by (1) visiting https://pe.tours/manage (2) clicking the "Manage Bookings" link at the top right of any page on the Website, or (3) if you have a User Account, going to the "Bookings" tab in your account dashboard and then selecting "Manage Reservation.”
8.3. A request to modify an existing Booking will be subject to availability and the approval of the Supplier. Upon approval from the Supplier, Project Expedition will issue you a new Booking Voucher that confirms the requested modifications.
8.4. Any transfer that is purchased via Project Expedition’s Transportation Platform cannot be modified and can only be canceled and rebooked. Cancellations of transfers are subject to the cancellation policy outlined on your Booking Voucher, so it is recommended that you purchase travel insurance that protects against the impact of a flight cancellation or modification. 8.5. If you experience an issue with a Booking, you must report it to Project Expedition no later than 14 days after the date of your reservation. All issues must be reported on time, in writing, and emailed to support@projectexpedition.com. Your failure to comply with these requirements will eliminate the possibility of a refund.

9. Other Cancellations and Modifications
9.1. If a Supplier cancels a Booking due to a situation outside of their control, including weather, mechanical failure, strikes, and other unforeseen events, then a full refund will be provided. However, in situations where only a portion of an original itinerary is impacted, then the Supplier is not required to cancel a Booking and may, at their discretion, offer a partial refund or an alternative of equal or greater value.
9.2. Please note that cancellations and changes related to weather are at the complete and total discretion of the Supplier. If you refuse to participate in a Booking because of the weather and your Booking is not canceled by the Supplier, then you are not due a refund.
9.3. You understand that some Products have additional restrictions or requirements, such as body weight and height requirements, age and health restrictions, and more. It is your responsibility to make yourself aware of this information prior to making a Booking. Failure to comply may result in the Supplier cancelling your Booking without a refund.
9.4. If you arrive late or fail to show up for a scheduled reservation, then you will not be eligible for a refund. It is your responsibility to become familiar with pick up instructions or the meeting location for a Booking prior to the start of your reservation.
9.5. In rare circumstances, Project Expedition may need to cancel a confirmed Booking. Project Expedition reserves the right to cancel or modify any Booking at any time. If a reasonable alternative cannot be arranged, Project Expedition will issue you a refund.

10. Refunds
10.1. Eligibility for a refund will be determined by the cancellation policy of your Booking. As per Section 8.1, it is your responsibility to familiarize yourself with the cancellation policy prior to making a Booking.
10.2. Approved refunds will be issued back to the original form of payment used to make a Booking.
10.3. Project Expedition will endeavor to process approved refunds within two business days. Once processed, it generally takes 5-7 business days for a refund to post back to the original form of payment (please note that this time frame is ultimately determined by the financial institution that issued the credit or debit card and is outside of Project Expedition’s control).
10.4. Should an error occur while processing a refund whereby the amount refunded is greater than the refund amount that was approved, Project Expedition reserves the right to process a new charge to correct the error.

11. Shore Excursions
11.1 Project Expedition offers Shore Excursions that provide additional benefits and protections to cruise passengers. All Shore Excursions on Project Expedition offer the Cruise Friendly Refund Policy, but not all Shore Excursions offer the Back to Ship Guarantee. You are responsible for checking and understanding which policies apply to your booking(s). The details of each policy are as follows:
11.1.1 Cruise Friendly Refund Policy
11.1.1.1 Shore Excursions with this benefit will offer a full refund if any of the following occur:
- Your cruise ship arrives late, and you miss your Shore Excursion as a result.
- Your cruise ship changes its date of arrival and it is not possible to reschedule.
- Your cruise ship skips port.
- Your cruise is canceled by the cruise line.
- You cancel prior to the Cancellation Deadline on your confirmation voucher.
11.1.1.2 In the event of a refund claim for one of these reasons, Project Expedition will verify the cruise ship’s actual itinerary before processing a refund. To be eligible for a refund, you must submit your claim in writing no later than 14 days after the scheduled date of the Shore Excursion.
11.1.2 Back to Ship Guarantee
11.1.2.1 Project Expedition guarantees that you will get back to your ship on time, provided that all of the following requirements apply:
- The Shore Excursion you booked offers the Back to Ship Guarantee.
- Your Shore Excursion is scheduled to end no less than 2 hours prior to the scheduled departure time of your cruise ship. It is your responsibility to confirm your ship’s departure time prior to booking, in addition to re-confirming the ship’s itinerary on the day of the Shore Excursion.
- You have not changed or deviated from the original itinerary of the Shore Excursion that you booked on Project Expedition.
- The delay in returning to the ship was due to no fault or action of your own.
11.1.2.2 In the event that you are not returned back to your cruise ship before it departs, Project Expedition will cover up to USD $500 per person towards transportation and/or accommodation necessary to travel to the next port of call. Receipts are required for reimbursement.
11.2 All tour start times on Project Expedition are displayed in the local time of the port of call. Please note that some cruise itineraries may utilize a different time zone.

12. Travel Documents and Insurance
12.1. It is your sole responsibility to ensure that you have the appropriate travel documents and prerequisites necessary for travel. This includes, but is not limited to passports, visas, and vaccinations.
12.2. Project Expedition does not sell travel insurance, but we strongly recommend that you purchase a comprehensive travel insurance policy prior to your departure. Depending on the policy, travel insurance may offer coverage for non-refundable expenses in the event of an unexpected cancellation or modification.

13. Chargebacks
13.1. All chargebacks will incur a processing fee of $20 per chargeback.
13.2. You understand that Project Expedition reserves the right to pursue legal action in the event that a chargeback is filed for a valid charge and Project Expedition incurs a loss as a result (also known as friendly fraud).
13.3. If a chargeback is filed prior to the travel date of a Booking, then Project Expedition may either require a new payment equal to the disputed amount to keep the Booking as originally scheduled, or Project Expedition may cancel the booking. In the event of a cancellation due to a chargeback, any relevant cancellation penalties will still apply.

14. Intellectual Property
14.1. Excluding third party content, the Website, including all content, text, graphics, design, computer code, software, logos, and trademarks are Copyright © - Project Expedition LLC - All Rights Reserved.
14.2. No content, text, graphics, design, computer code, software, logos, or trademarks on this Website or on any Project Expedition affiliated product may be reproduced, copied, transferred, downloaded, scraped, databased, or otherwise acquired or distributed without the prior written consent of Project Expedition.
14.3. Project Expedition goes through great lengths to ensure that all content on the Website is appropriate and that it meets necessary attribution requirements. If you see any content that you believe should not be displayed on the Website, or if you see content that may infringe on existing intellectual property rights, please email us at: support@projectexpedition.com
14.4. Users of the Website are expressly prohibited from using 'Project Expedition', any derivative of 'Project Expedition', or any marks related to or associated with 'Project Expedition' for the purposes of keyword advertising, search engine marketing, or in any manner that may lead to the misrepresentation of the 'Project Expedition' brand, or direct potential users away from the Website.

15. Links to Third Party Sites
15.1. The Website may contain links to third party websites not operated by Project Expedition. These links are for your reference only. Project Expedition does not control these websites and is not responsible for their content or privacy practices. Please take necessary precautions when navigating to third party websites.

16. Limitations of Liability,
16.1. Suppliers listed on the Website are third party entities and are not agents or affiliates of Project Expedition. Project Expedition is not liable for any injuries, death, sickness, accidents, property damage, delays, neglect, poor weather, negative consequence or expenses caused, made possible by, or associated with the Supplier, their Products, their Bookings, or their affiliates.
16.2. Project Expedition is not responsible for any damages, loss of revenue, loss of business, loss of opportunity, loss of reputation, or any negative consequence associated with the use of this Website or any Project Expedition product or service.
16.3. As per Section 1.3, Project Expedition cannot guarantee the accuracy of information on the Website and disclaims any and all liability relating to any inaccuracies. Should a Booking be made under an incorrect price, Project Expedition reserves the right to collect payment from the User for the correct price or cancel the Booking.
16.4. Project Expedition has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, acts of war, terrorism, epidemic, pandemic, police or military operations, unforeseen road hazards, accidents and related delays, force majeure, or other causes beyond our direct control, and we have no responsibility for any additional expense, omissions, delays, re-routing, or acts of any government or authority.
16.5. If Project Expedition is found liable for any loss or damage related to your participation in a Booking, Project Expedition’s maximum liability shall not exceed the amount that you paid for the Booking related to the claim.
16.6. If a Booking is canceled by Project Expedition or by a Supplier, then Project Expedition shall not be liable for any cost associated with the purchase of an alternate or replacement service.

17. Indemnification
17.1. You agree to defend and indemnify Project Expedition and all of their respective officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, suits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs, and any other liabilities of any kind or nature including but not limited to reasonable legal and accounting fees, arising out of or related to:
17.1.1. Your breach of these Terms of Use;
17.1.2. Your violation of any law or the rights of a third party;
17.1.3. Your use of the Website;
17.1.4. Your participation in any Product or Booking; or
17.1.5. Your negligence or willful misconduct.

18. Severability
18.1. In case any provision of these Project Expedition Terms of Use shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall, to the extent permitted by law, not in any way be affected or impaired thereby.

19. General Provisions
19.1. You agree that no joint venture, partnership, or employment relationship exists between you and Project Expedition as a result of these Terms of Use or your participation in the Website, Products, or Bookings.
19.2. These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York. Any legal action arising out of or relating to these Terms of Use will be brought only in the courts of the State of New York.
19.3. These Terms of Use, in addition to the Travel Advisor Terms and Conditions and Supplier Terms and Conditions where applicable, constitute the entire agreement between you and Project Expedition with respect to the Website, Products, and Bookings, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Project Expedition.
19.4. Any rights not expressly granted herein are reserved.

20. Accessible Tours
20.1 Wheelchair Accessible tours: A Wheelchair Accessible tour is defined as a tour that you can fully participate in while remaining in a wheelchair, with the following expectations:
20.1.1 Venues on the tour are 100% wheelchair accessible. Exits and entrances have ramps/elevators that can be accessed without the use of stairs.
20.1.2 If applicable, transportation vehicles will allow you to get in and out of the vehicle without needing to be removed from your wheelchair.
20.1.3 If the venue cannot allow access to a wheelchair, a full refund will be provided.
20.1.4 Each guest in a wheelchair must be accommodated by one adult (18+) who can assist with mobility needs.
20.2 Limited Mobility Required tours: An Accessible Tour with Limited Mobility Required is a tour where you may be required to walk or stand for a very limited time, with the following expectations:
20.2.1 Venues (and transportation vehicles) may require that guests are physically able to get up and out of their wheelchair for limited mobility such as walking or steps.
20.2.2 These tours cannot accommodate wheelchairs and other mobility devices that cannot be easily carried up and down a few steps and/or out of a vehicle.
20.2.3 If you require the assistance of a wheelchair (or other mobility device), you must bring it with you.
20.2.4 If you rent or borrow a wheelchair from the tour operator or a third party vendor, Project Expedition is not be liable for any issues that may arise from the use of such device.
20.2.5 Each guest must be accommodated by one adult (18+) who can assist with mobility needs.
